Cadence English — Terms of Service

These Terms of Service ("Terms") govern access to and use of the online courses, practice content, quizzes, mock examinations, marking services, and related materials (the "Services") provided by Cadence English ("Cadence English," "we," "us," or "our") through our Thinkific-hosted site (the "Site"). By creating an account, purchasing a subscription, or otherwise using the Services, you agree to these Terms. If you are under 18, a parent or legal guardian must review and agree to these Terms on your behalf and is responsible for your use of the Services.
1. Who we are
Cadence English provides online English-language learning products for Hong Kong K-12 students, including daily practice, listening and reading skills courses, writing courses, and monthly mock examinations with AI-assisted and human-reviewed marking. The Services are operated by Cadence English Ltd, a company registered in England and Wales (Company Number 17193421), registered office at Forma House, 40 Bowling Green Lane, London, EC1R 0NE. 2. Eligibility and accounts
You must provide accurate registration information and keep your account credentials confidential. Accounts are personal to the registered student and may not be shared or resold.
Many of our students (particularly in Forms 4-6) register and manage their own account directly, using their own email address, without a parent creating or logging into the account. This clause applies regardless of who physically completes registration: if the registered student is under 18, their use of the Services and any purchase made on the account is deemed to be with the knowledge and consent of, and on behalf of, a parent or legal guardian, who remains the person legally responsible for payment, account use, and compliance with these Terms — whether or not that parent or guardian was the one who filled in the signup form. A student who registers their own account confirms, by doing so, that they have their parent or guardian's permission to use the Services and to authorize any associated payment.
We do not independently verify age or parental consent at signup. If we become aware that a student under 18 has registered without appropriate parental knowledge or consent, we may suspend the account and will work with the parent/guardian to resolve it.
3. Subscriptions, billing, and free tasters
Some courses are offered as free or low-cost "taster" content so you can try the platform, teaching style, and content format before subscribing. Paid courses are billed on a recurring monthly (or otherwise stated) basis to the payment method on file, in Hong Kong dollars (HKD), until cancelled. By subscribing, you authorize us (and our payment processor) to charge your payment method automatically at the start of each billing cycle.
Prices and available plans (including bundle pricing) are shown on the Site at the time of purchase and may change for future billing cycles with reasonable notice.
4. Cancellations
You may cancel your subscription at any time through your account settings or by emailing [email protected]. Cancellation stops future renewal charges but does not end your access to already-purchased content until the end of the current paid billing period. There is no partial-period credit for early cancellation.
5. Refund policy
Because we offer free or low-cost taster content that lets you evaluate the course before committing to a paid subscription, paid subscription charges are non-refundable once processed, including the first billing cycle. This applies to monthly plans, bundles, and one-time purchases (such as standalone papers or mock examination packs) alike.
Exceptions we will consider on a case-by-case basis, at our discretion:
A duplicate or clearly erroneous charge (e.g., billed twice for the same period).
A demonstrated technical failure on our part that prevented you from accessing the course materials you paid for, where we were unable to resolve the issue after being notified.
To raise a billing concern, email [email protected] within 14 days of the charge with your account email and order details. We aim to respond within 3 business days.
This refund policy does not affect any non-waivable statutory rights you may have under Hong Kong law.
6. Course content, scheduling, and drip release
Some courses release lessons, quizzes, or mock content on a fixed daily, weekly, or monthly schedule ("drip schedule") rather than all at once. Course pacing, drip schedules, and content order may be adjusted from time to time to improve the learning experience; where reasonably possible we will give notice of material changes to an in-progress course.
7. AI-assisted and human marking
Certain assessments (e.g., writing tasks, monthly mocks) are marked using a combination of AI-assisted scoring and human review against a published rubric. Marks and feedback are provided for learning and practice purposes and are not official HKDSE or other examination results, and are not guaranteed to predict actual examination outcomes.
8. Acceptable use
You agree not to: share your account or course content with others outside your household; copy, reproduce, redistribute, or resell any course materials, papers, audio, or marking rubrics without our written permission; use the Services for any unlawful purpose; or attempt to circumvent content access controls.
9. Intellectual property
All course content, papers, audio recordings, quizzes, and marking rubrics are owned by or licensed to Cadence English and are protected by copyright. Your subscription grants you a personal, non-transferable licence to access the content for your own study, and does not transfer any ownership rights.
10. Disclaimers and limitation of liability
The Services are provided "as is" for educational practice purposes. While we aim for exam-realistic, high-quality content, we do not guarantee any particular examination result or grade. To the maximum extent permitted by law, Cadence English's total liability for any claim relating to the Services is limited to the amount you paid us in the 3 months preceding the claim.
11. Changes to these Terms
We may update these Terms from time to time. Continued use of the Services after an update constitutes acceptance of the revised Terms. Material changes will be posted on this page with an updated "Last updated" date.
12. Governing law
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles.
